Consell Insular and Local Governments Join Forces to Collect Fines for Urban Planning Infringements
When an urban planning infringement proceeding is initiated, the process goes beyond simply restoring the altered physical reality. The responsible parties must legalise or demolish any irregular construction — either voluntarily or through enforcement — and can also face substantial financial penalties.
Under Article 186 of the LUIB (Balearic Islands Urban Planning Law), the Administration has the authority to impose fines on those who breach planning regulations.
Cooperation Between Consell Insular and the Balearic Tax Office
The body responsible for carrying out these proceedings is the Agència de Defensa del Territori (Agency for Territorial Defence), a regional department of the Consell Insular de Mallorca.
To streamline the process and improve efficiency, the Consell Insular has signed a four-year cooperation agreement with the Balearic Inland Revenue Office. This collaboration enables both entities to jointly manage and collect all income derived from planning infringement proceedings — including:
- Fines imposed for planning violations.
- Recovery of costs incurred by the Agency when offenders fail to voluntarily restore the affected property or area.
This agreement aims to ensure faster and more effective enforcement of urban planning regulations, while also increasing accountability among property owners and developers.
